TEXT ORDER entered by District Judge Jonathan E. Hawley on 11/19/2024. Plaintiff filed a Motion to Waive Reduced Fee5 asking the Court to waive the $12.14 partial filing fee imposed in the Text Order entered November 8, 2024. Plaintiff states that he has a remaining trust fund ledger balance of $82.45 after spending approximately $1400.00 on a headstone for his sister, clothes, shoes, and hygiene items over the past six months. The filing fee the Court imposed is a fraction of the funds Plaintiff has remaining in his account. Plaintiff must consider the costs of filing this lawsuit against any future expenditure he intends to make, just like any other litigant. Plaintiff's motion5 is DENIED. Lumbert v. Ill. Dept of Corrs., 827 F.2d 257, 259 (7th Cir. 1987) (courts may impose modest fees on individuals who file lawsuits, and a litigant who "thinks that a more worthwhile use of his funds would be to buy [commissary items]than to file a civil rights suit hasdemonstrated an implied evaluation of the suit that the district court is entitled to honor."). Plaintiff shall pay the reduced filing fee by the deadline in the Court's November 8, 2024, Text Order. Failure to do so will result in dismissal of this case without prejudice. (ANW) |

TEXT ORDER: This Court has instituted a reduced filing fee procedure for indigent plaintiffs who are institutionalized but who are not prisoners as defined in 28 USC Section 1915(h). A reduced payment will be assessed of 50% of such plaintiff's average monthly income for the six months preceding the filing of the complaint (not to exceed the $405 filing fee). Income includes all deposits from any source. Plaintiff Minosa Echols is currently detained at Rushville Treatment and Detention Facility, and is thus subject to the reduced payment procedure. Plaintiff's ledgers for the past six months show an average monthly income of $24.27. Plaintiff is ordered to send an institutional check or money order in the amount of $12.14, payable to Clerk, U.S. District Court within 30 days from the date of this order. The reduced fee may be waived if the plaintiff, within 14 days of this order, files a motion to waive the fee and demonstrates good cause for such waiver.
