TEXT ORDER: The Court has reviewed Defendant Booker and Booker Logistics, LLC's (Booker and Booker) 3 answers to the Local Civil Rule 26.01 Interrogatories, and determines answer C to be incomplete and answer H to be unresponsive. Whether or not publicly-owned, corporations are required to respond to all subparts of Interrogatory C. As appropriate they may state "none" in response to each subpart. "Not applicable" is not a valid response. Regarding Interrogatory H, Booker and Booker fails to provide information necessary to determine the citizenship of that party which is a limited liability company ("LLC"). Citizenship of an LLC is determined based on the citizenship of its members, not based on a "state of incorporation" and principal place of business. See General Technology Applications, Inc. v. Exro Ltda, 388 F.3d 114 (4th Cir. 2004). Defendant shall file amended, complete, responsive answers no later than December 2, 2024. IT IS SO ORDERED.
