Minute Order by Judge Jinsook Ohta: On December 9, 2024, Defendant removed this action to federal court based on diversity jurisdiction. Dkt. 1. In actions removed on diversity jurisdiction grounds, while courts generally accept the amount demanded in the complaint so long as the amount is requested in good faith, courts need not accept allegations or demands that are conclusory or based on unwarranted deductions of facts. Nation v. Samsung Elecs. Am., Inc. , No. 2:23-cv-07413, JLS-E, 2023 WL 6879342, at *1 (C.D. Cal. Oct. 17, 2023); In re Gilead Scis. Sec. Litig. , 536 F.3d 1049, 1057 (9th Cir. 2008). Here, the Court has concerns regarding whether the amount in controversy requirement of diversity jurisdiction is met. Defendant relies solely on Plaintiff's request in the state-court complaint for $500,000.00, but, absent greater evidence supporting this request, the Court finds the statement conclusory and insufficient to establish by a preponderance of the evidence that the amount in controversy exceeds $75,000. As such, the Court hereby ORDERS Defendant to show cause as to why this matter should not be dismissed for lack of subject matter jurisdiction.
