Minute Order by Judge Jinsook Ohta: On December 12, 2024, Defendant removed this action to federal court based on diversity jurisdiction. Dkt. 1. Settlement demands are relevant evidence of the amount in controversy if the demands appear to reflect a reasonable estimate of a plaintiff's claim. Cohn v. Petsmart, Inc. , 281 F.3d 837, 840 (9th Cir. 2002). Here, Defendant argues the amount in controversy requirement is met because Plaintiff has made a demand in excess of $75,000. However, Defendant failed to attach this demand, and, due to the sparse nature of the allegations in the original state-court complaint, the Court cannot determine if such a demand reflects a reasonable estimate of Plaintiff's claims. As such, the Court has concerns regarding if the amount in controversy requirement is met, and thus the Court ORDERS Defendant to show cause on or before January 10, 2025, why this matter should not be remanded for lack of subject matter jurisdiction. Plaintiff shall respond by January 24, 2025. The hearing on this matter is scheduled for January 30, 2025, at 9:00 a.m. at which time it will go under submission without oral argument.
