ORDER DISMISSING1 Complaint without prejudice and ORDER to file Amended Pleading. Plaintiff filed this action under 42 U.S.C. 1983 for alleged constitutional deprivations that occurred when he was assaulted with urine by another inmate and subjected to other unconstitutional conditions at Menard Correctional Center. He refers to no defendants in the statement of his claim and instead mentions "officers," "counselors," "grievance officer," "warden," and "Springfield." Section 1983 liability hinges on personal involvement in a constitutional deprivation. Matz v. Klotka, 769 F.3d 517, 528 (7th Cir. 2014). To state a claim, Plaintiff must name each individual wrongdoer as a defendant in the case caption and also describe what each person did to violate his rights in the statement of clam. Id. If Plaintiff does not know each defendant's name, he can still identify each one in the case caption and statement of claim using a generic name, like "John Doe 1," "Jane Doe 1," etc. Plaintiff's Complaint does not survive screening under 28 U.S.C. 1915A because he fails to refer to any defendants by name or briefly describe what each person did to violate his constitutional rights in his statement of claim. Plaintiff is GRANTED leave to file a "First Amended Complaint" in this case, Case No. 24-cv-2624, on or before JANUARY 22, 2025. The First Amended Complaint will supersede and replace the original, and it will be screened under 28 U.S.C. 1915A. To ensure Plaintiff's compliance with this Order, the Clerk's Office is DIRECTED to SEND Plaintiff a blank civil rights complaint form and copy of the1 Complaint, along with this Order.
