ORDER. The Clerk has entered default. The Court provides the following guidance regarding any forthcoming motion for default judgment. Any motion for default judgment must comply Federal Rule of Civil Procedure 55(b) and applicable caselaw. At a minimum, any motion must make a prima facie showing that the Court has subject-matter and personal jurisdiction, and must show that the unchallenged facts create a legitimate basis for entry of judgment by identifying the prima facie elements of the claims for which default judgment is sought and the allegations that support them. Although a hearing may be necessary to assess damages, any motion should also set out and provide support for the damages sought, including any request for attorneys' fees. Any motion that does not satisfy these standards will likely be summarily denied without prejudice. The Court strongly encourages Plaintiff to review the applicable standards before filing a motion for default judgment. The Court is unlikely to award any fees (even if available) for work done on a motion for default judgment that falls noticeably short of those standards. Signed by District Judge Holly L.
