TEXT ORDER by US Magistrate Judge Karen McNaught on 12/20/2024: Plaintiff has filed a Motion for Leave to File in Forma Pauperis2 . To proceed without prepayment of the filing fee pursuant to 28 U.S.C. Section 1915(a), plaintiff must file an affidavit attesting to his income and debts and be able to demonstrate he does not have sufficient assets to pay the court's filing fee. Based upon the affidavit filed by plaintiff in his motion to proceed as a pauper, this Court is not persuaded plaintiff cannot afford to pay the filing fee. This Court denies plaintiff leave to proceed without the prepayment of the filing fee. Plaintiff must pay the filing fee by 1/31/2025. If plaintiff fails to pay the filing fee, the Court will interpret plaintiff's silence as his desire not to proceed, and the Court will dismiss this case.(RES) |
