9 9 order Order Fri 12/27 10:39 AM
ELECTRONIC ORDER: On December 19, 2024, the defendant removed this civil action to this court. This court is required to examine the basis for its subject matter jurisdiction, on its own motion if necessary. Diversity of citizenship jurisdiction requires complete diversity. The plaintiffs are alleged to be "individual[s] residing in Rockwall County, Texas." Plaintiff's [sic] Original Petition at 1, attached to 1 Defendant Muzom Transportation Inc.'s Notice of Removal. The allegations of residence for the plaintiffs are not sufficient as allegations of citizenship. See Strain v. Harrelson Rubber Company , 742 F.2d 888, 889 (5th Cir. 1984) (per curiam) (citations omitted); see also MidCap Media Finance, L.L.C. v. Pathway Data, Inc. , 929 F.3d 310, 313 (5th Cir. 2019). From the plaintiffs' allegations, the court cannot tell whether there is diversity of citizenship or not. Accordingly, no later than January 6, 2025, the defendant shall file and serve an amended notice of removal that alleges the citizenship of the plaintiffs. Failure to timely file and serve such an amended notice of removal will result in remand to the 354th Judicial District Court, Hunt County, Texas, without further notice. (Ordered by Senior Judge A. Joe Fish on 12/27/2024) (chmb)
