Order on Motion to Proceed in Fictitious Name
Tue 01/21 12:28 PM
ORDER granting2 Motion to Proceed in Fictitious Name. After careful consideration of the factors enumerated in Sealed Plaintiff v. Sealed Defendant , 537 F.3d 185, 189-90 (2d Cir. 2008), the Court finds on the current record that the Plaintiff's interest in anonymity outweighs the countervailing public interest in full disclosure and any prejudice to the Defendant. The Plaintiff's allegations are highly sensitive and of a personal nature. Furthermore, the use of a pseudonym appears unlikely to impede the resolution of the case or the public's interest in the litigation, particularly at this early stage. See H.G. v. Inter-Cont'l Hotels Corp. , 489 F. Supp. 3d 697, 713 (E.D. Mich. 2020) ("Courts in cases that involve victims of sex traffickers routinely allow plaintiffs, at least at the early stages of the litigation, to proceed under a pseudonym due to the sensitive and intimate nature of their allegations."). Thus, the Court finds that allowing the Plaintiff to proceed anonymously is in the interests of justice. Accordingly, the motion is granted . The Court acknowledges that the Defendant has yet to appear - and that, once it does, it may possess additional relevant factual information that is not currently before the Court, or may have a different view of the balance of factors. The granting of this motion is therefore without prejudice to a motion to lift the order allowing the Plaintiff to proceed under a pseudonym. Any such motion shall refer to the Plaintiff "S.L." or "Plaintiff." If the motion contains other information with the potential to identify the Plaintiff, it must be filed under seal pursuant to D. Conn. L. Civ. R. 5(e). It is so ordered. Signed by Judge Thomas O. Farrish on 1/21/25. (Wood, R.) |
