ORDER granting1 Application for Leave to Proceed in forma pauperis. The Clerk is DIRECTED to submit this case to the District Court for a frivolity determination. Claims for violations of the United States Constitution brought under 42 U.S.C. § 1983 are tort actions subject to the statute of limitations governing personal injury actions in the state where the lawsuit is pending. Crowe v. Donald, 528 F.3d 1290, 1292 (11th Cir. 2008). In Georgia, the proper limitations period for all § 1983 claims is the two-year period set forth in O.C.G.A. § 9-3-33 for personal injuries. Inman v. State Bar of Ga., 611 F. Appx 579, 581 (11th Cir. 2015) (per curiam). Absent a showing that the limitations period must be tolled in this case, plaintiffs § 1983 claims are frivolous, as he alleges the events at issue occurred on February 22, 2022 and January 2, 2023, more than two years after he initiated this action on January 8, 2025.
