ORDER re:2 Emergency Motion for a Temporary Restraining Order and Preliminary Injunction. To the extent the plaintiff seeks issuance of a temporary restraining order without notice to the defendants and an opportunity for the defendants to be heard, that request is denied. The Court will treat the motion as a motion for a preliminary injunction pursuant to Federal Rule of Civil Procedure 65(a). As soon as possible but no later than noon on 1/14/2025, the plaintiff must serve each defendant with (1) a summons; (2) the complaint, Doc.1 , and all attachments thereto; (3) the plaintiff's emergency motion, Doc.2 , and all attachments thereto; and (4) this Order. The plaintiff must promptly file proof of service in accordance with Federal Rule of Civil Procedure 4(l)(1). A Motion Hearing is SET for 1/24/2025 at 01:30 PM in Courtroom A1002 before Judge Daniel D. Domenico. The parties must jointly file a proposed briefing schedule by noon on 1/15/2025. If the parties cannot agree on a briefing schedule, the Court will set one. Pursuant to Federal Rule of Civil Procedure 43(c), all direct witness testimony must be submitted by affidavit in advance of the hearing as attachments to the parties' briefs, and live testimony at the hearing will be limited to cross-examination and redirect examination. If the parties intend to present evidence at the hearing, they must file their exhibit and witness lists and provide the Court and the opposing side with electronic copies of any exhibits not already in the record by noon on 1/23/2025. Exhibit and witness list forms can be found at http://www.cod.uscourts.gov/JudicialOfficers/ActiveArticleIIIJudges/HonDanielDDomenico.aspx . The exhibits may be delivered to the Court on USB flash drive or submitted by email to Domenico_Chambers@cod.uscourts.gov as attachments or via secure download link.
