NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis ; in other words, he seeks to commence a federal lawsuit without pre-paying the filing fee. A federal law, 28 U.S.C. § 1915, permits him to do so if, among other things, he submits a financial affidavit showing that he is unable to pay, accompanied by a certified copy of his inmate trust account statement for the six-month period preceding his complaint. In this case, Mr. Shabazz has submitted a financial affidavit and trust account statement. The affidavit states that the plaintiff received more than $6,500 in disability payments over the past twelve months. The trust account statement shows that the plaintiff also received more than $900 in deposits in the past four months. Given this, the Court requests more information from Mr. Shabazz to determine whether he meets the standard for in forma pauperis status. Mr. Shabazz is directed to submit a statement to the court (a) explaining where the $6,500 went, including how it was spent and if any of it remains; and (b) explaining where the $900 in deposits went, including how it was spent. This statement may be handwritten but must (a) include the case name of Shabazz v. Quiros et al and the case number of 25-cv-65; (b) be signed under the penalty of perjury; and (c) be submitted to the Court no later than February 5, 2025. If he wishes, Mr. Shabazz may pay the $405.00 filing fee rather than file the statement.
