ORDER: The Court held an initial conference in plaintiff's personal injury case on January 15, 2025. Simon Landsberg appeared on behalf of plaintiff; Daniel Wang appeared on behalf of defendants. The matter was originally filed in Kings County Supreme Court on October 23, 2024 and removed to the Eastern District on December 19, 2024 pursuant to 28 U.S.C. § 1446. While the action was properly removed to this district, this Court is not the proper venue to hear this action. The case is hereby transferred, with the parties' consent, to the U.S. District Court for the Southern District of New York pursuant to 28 U.S.C. § 1404, as the accident at issue in this case occurred at 12th Avenue and West 50th Street in Manhattan and defendants are domiciled in New Jersey and Illinois. 28 U.S.C. § 1404; 28 U.S.C. 1391(b); ECF No. [1-1]. The Clerk of Court is respectfully directed to transfer this case to the Southern District forthwith. The Court waives compliance with Rule 83.1 of the Local Rules for the Eastern District of New York, which otherwise imposes a seven-day delay in the transfer of relevant case materials. | ORDER: Defendants Geza Jozsef Patko and Phoenix Expedited Inc. removed this motor vehicle case from Kings County Supreme Court on December 19, 2024, invoking this Court's diversity jurisdiction under 28 U.S.C. § 1332. ECF No.1 . Defendants answered plaintiff's complaint on December 23, 2024. ECF No.6 . The Court shall hold the initial conference in this matter on January 15, 2025 at 10:30 a.m. in Courtroom 11A South of the United States Courthouse, 225 Cadman Plaza East, Brooklyn, New York. The parties shall exchange their Rule 26(a)(1) initial disclosures and file a 26(f) Meeting Report by January 8, 2025. Any party seeking a trial by jury shall file a jury demand by the same date.
