ORDER DISMISSING CASE: The 2 motion to proceed in forma pauperis is granted. However, plaintiff?s 1 complaint is dismissed as frivolous. A district court may dismiss a case sua sponte if it determines that the action is frivolous. Fitzgerald v. First East Seventh Street Tenants Corp. , 221 F.3d 362, 363-64 (2d Cir. 2000). A complaint must plead ?enough facts to state a claim to relief that is plausible on its face,? Bell Atlantic Corp. v. Twombly , 550 U.S. 544, 570 (2007), and ?allow[] the court to draw the reasonable inference that the defendant is liable for the misconduct alleged,? Ashcroft v. Iqbal , 556 U.S. 662, 678 (2009). ?An action is frivolous when either: (1) the factual contentions are clearly baseless, such as when allegations are the product of delusion or fantasy; or (2) the claim is based on an indisputably meritless legal theory.? Livingston v. Adirondack Beverage Co. , 141 F.3d 434, 437 (2d Cir. 1998) (citation and quotation marks omitted). Even under a liberal reading, plaintiff's allegations are frivolous. Plaintiff asserts that she is the victim of cloning and surveillance, including a plan involving ?an army of 3000 year old Scythian warriors,? ?k vehicle with skulls,? and ?different types of lights used to achieve everything planned.? Complaint 8. These allegations appear to be ?the product of delusion or fantasy,? Livingston , 141 F.3d at 437, and do not suggest that defendants are ?liable for the misconduct alleged,? Ashcroft , 556 U.S. at 678. Further, to the extent plaintiff?s allegations concern the custody of her daughter, the Court lacks subject matter jurisdiction over such claims. See Fitzgerald v. First E. Seventh St. Tenants Corp. , 221 F.3d 362, 363 (2d Cir. 2000); Fed. R. Civ. P. 12(h)(3). Plaintiff may file an amended complaint within 30 days. The new complaint must be captioned ?Amended Complaint? and shall bear the same docket number as this order. Plaintiff is advised that the amended complaint will replace her original complaint. If plaintiff does not file an amended complaint within 30 days, judgment shall be entered dismissing this case. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore IFP status is denied for the purpose of an appeal. Coppedge v. United States , 369 U.S. 438, 444-45 (1962). The Clerk of Court is respectfully directed to mail a copy of this order to plaintiff and file proof of mailing on the docket. Ordered by Judge Rachel P.
