FINDINGS, CONCLUSIONS, AND RECOMMENDATION REGARDING DEFENDANT'S FEDERAL RULE OF CIVIL PROCEDURE 12(b)(2) MOTION TO DISMISS PLAINTIFF'S ORIGINAL COMPLAINT FOR LACK OF PERSONAL JURISDICTION: Having carefully considered the motion, response, and reply, the Court RECOMMENDS that Everdays'8 Motion to Dismiss be PARTIALLY GRANTED in that the Court does not have personal jurisdiction over Everdays. However, instead of dismissing the case, the Court RECOMMENDS, as set forth below, that the case be TRANSFERRED to the United States District Court for the District of Delaware as requested by Plaintiff. Objections to F&R due by 1/16/2025. It is further ORDERED that if objections are filed and the opposing party chooses to file a response, the response shall be filed within seven (7) days of the filing date of the objections.
