PAPERLESS ORDER. THIS CAUSE is before the Court upon a sua sponte review of the National Labor Relations Board's ("NLRB")1 Application for Order Requiring Obedience to Subpoena Duces Tecum ("Application"). The Application is lacking in several respects, and the NLRB shall be granted until February 28, 2025 to file an Amended Application that remedies the issues outlined below. First, the Application's case caption lists One Lifestyle Management, LLC and Alibi Wilton Manors as Respondents. However, aside from the case caption, the Application makes no mention of Respondent Alibi Wilton Manors. As such, the case caption must be amended or the NLRB must explain the relevance of Respondent Alibi Wilton Manors to this action. Second, the Application fails to explain the significance of Respondent One Lifestyle Management, LLC's employees being "comprised of former employees of Harvard Maintenance" and Respondent being "a successor employer to Harvard." (D.E. 1-2 at 1). The NLRB must make this necessary link for the Court in the Amended Application. Third, the Charge Against Employer (D.E. 1-2 at 1) lists an address of 40307 Fisher Island Dr., Miami Beach, FL 33109 for Respondent One Lifestyle Management, LLC. However, Exhibit 8 of the Application (D.E. 1-2 at 28), shows that the NLRB's subpoena duces tecum was served on Respondent One Lifestyle Management, LLC by certified mail at 1210 Stirling Road, Unit 4A, Dania Beach, FL 33004. In the Amended Application, the NLRB shall SHOW CAUSE why service by certified mail upon an unnamed individual at the aforementioned location in Dania Beach provides Respondent One Lifestyle Management, LLC with sufficient notice.
