order Text-Only Order Wed 02/19 4:45 PM
TEXT-ONLY ORDER: The Court has reviewed the removal notice and the complaint filed in this case. The case was removed based on diversity jurisdiction. The Court needs additional information to verify that there is complete diversity of citizenship between the parties. The removal notice cites to the complaint in alleging that (1) Plaintiff Ali Abdallah is a resident and citizen of Michigan and (2) Defendant Daniel Wayne Bush is a citizen of Indiana. (ECF No. 1, PageID.2.) The complaint, however, alleges that Plaintiff is a resident of Michigan and that Defendant resides in Indiana. (Id. at PageID.8.) For purposes of determining whether diversity jurisdiction exists, residence and citizenship are not equivalent. See Prime Rate Premium Fin. Corp., Inc. v. Larson, 930 F.3d 759, 765 (6th Cir. 2019). Citizenship instead turns on domicile. Id. (internal citation omitted). Accordingly, by February 26, 2025, the parties must file a stipulation on the docket that confirms the citizenship of each party. Signed by District Judge Judith E. Levy. (WBar)
