TEXT ORDER granting2 Motion for Leave to Proceed in forma pauperis. The Motion of the Plaintiff, Anton Liverpool, to Proceed In Forma Pauperis (ECF No. 2) is GRANTED. Mr. Liverpool has satisfied his burden of pleading a claim pursuant to the Eighth Amendment, with jurisdiction through 42 U.S. §1983, that he was subjected to a serious medical risk to his health which was deliberately disregarded. Estelle v. Gamble , 429 U.S. 97, 104 (1976). Nonetheless, pursuant to 28 U.S.C. §1915(a), Mr. Liverpool must pay the filing fee of $350, but he may pay in installments. The first installment must be equal to the greater of 20% of the average monthly balance in his inmate account over the last six months or 20% of the average amount of monthly deposits into that account over the same period. The account provided by the Department of Corrections is of a very limited period and reveals an average balance of $15.00 and no deposits. Therefore, the first installment is $3.00, and the Adult Correctional Institutions ("ACI") is directed to remit that amount to the Court. Thereafter, the ACI is directed to remit to the Court monthly 20% of the balance in the account during each preceding month, so long as the balance is over $10, until the entire filing fee is paid. Service on the defendants will be made electronically in accordance with the agreement between the Court and the Rhode Island Attorney General. So Ordered by Chief Judge John J.
