ORDER denying in part4 Emergency Motion for a Temporary Restraining Order and Preliminary Injunction. For the reasons described below, the Court denies Plaintiffs' emergency motion insofar as it seeks an ex parte temporary restraining order ("TRO"). Where a TRO is sought ex parte , "'stringent restrictions'" are imposed, which "'reflect the fact that our entire jurisprudence runs counter to the notion of court action taken before reasonable notice and an opportunity to be heard has been granted both sides of a dispute.'" Matter of Vuitton et Fils S.A. , 606 F.2d 1, 3-4 (2d Cir. 1979) (quoting Granny Goose Foods, Inc. v. Teamsters , 415 U.S. 423, 438-39 (1974)). Generally, ex parte TROs should only be granted where necessary to maintain the status quo , or where notice to an adverse party is impossible or would "render fruitless further prosecution" of the case. Id. at 4-5; Chapman v. Merch. Mart Props. , No. 2:07-CV-61, 2007 WL 922258, at *3 (D. Vt. Mar. 23, 2007); see also 11A Fed. Prac. & Proc. Civ. § 2952 (3d ed.) (noting that, to issue an ex parte TRO, the supporting affidavits should demonstrate "there is immediate and great danger of irreparable injury that necessitates the temporary dispensing of some of the trappings of due process"). None of these circumstances are present here. First, Plaintiffs are asking the Court to change, rather than maintain, the status quo by requesting that it order Defendants to refrain from enforcing current state and federal laws. Second, Plaintiffs have demonstrated through their filings that notice to Defendants has been attempted and is possible. Third, providing notice of the TRO sought would not render further prosecution of this case "fruitless" because it would not limit the viability of Plaintiffs' claims or the relief available to Plaintiffs should they prevail either on this motion or in the broader lawsuit. More broadly, as the laws Plaintiffs challenge have been in effect for some time, the Court cannot find there is a true need to proceed as urgently as Plaintiffs request. See Goldstein v. Hochul , No. 22-CV-8300 (VSB), 2022 WL 20305832, at *2 (S.D.N.Y. Oct. 3, 2022). For these reasons, the Court finds that the circumstances in this case do not command the issuance of an ex parte TRO and the Court denies Plaintiffs' emergency motion insofar as it seeks such an order. Although the Court declines to issue an ex parte TRO, it acknowledges that, in the alternative, Plaintiffs request that the Court issue a ruling on its motion for a TRO "at the earliest possible time that all parties can be heard." ECF No. 4-1 at 2. To that end, the Court orders Plaintiffs to file notice of the status of their outreach to each Defendant in this matter by February 24, 2025, at 12:00 PM . Additionally, a virtual status conference will take place on February 25, 2025, at 10:00 AM , to set a briefing schedule and hearing date for the TRO motion. To the extent possible, counsel shall confer about a proposed briefing schedule and hearing date in advance of the status conference. Plaintiffs shall send a copy of this order to all counsel for Defendants via email, and file notice on the docket confirming compliance with this order by February 24, 2025, at 12:00 PM . Defendants shall file notices of appearances as soon as practicable. The Clerk also is directed to send a copy of this order via email to the email addresses listed for anticipated defense counsel in Plaintiffs' certification of service, ECF No. 4 at 4, and to Assistant United States Attorney Michelle McConaughy.
