TEXT ORDER Entered by Judge Colin Stirling Bruce on 2/26/2025. Pro se Plaintiff Ryan Arroyo filed a Complaint1 against Defendant Owens - Illinois, alleging that Defendant violated his right to have protected medical leave under the FMLA while undergoing treatment for a medical condition covered by the Americans with Disabilities Act. Plaintiff resides in Streator, Illinois, and lists an address in Streator, Illinois, for Defendant, which is located in the geographical bounds of the Northern District of Illinois. The only connection to the Central District of Illinois is Plaintiff's correspondence with an individual at a company based in Springfield, Illinois, recommending treatment options to Plaintiff. However, additional correspondence attached to the Complaint indicates that Plaintiff rejected that option and stated that any treatment outside of [S]treator is honestly out of the question. The bulk of the events described in the Complaint appear to connect with Defendant's operations in its Streator office. Thus, Plaintiff has filed his suit in the wrong district. A district court of a district in which is filed a case laying venue in the wrong division or district shall dismiss, or if it be in the interest of justice, transfer such case to any district or division in which it could have been brought. 28 U.S.C. § 1406(a). Although no party has yet requested a transfer, a court, where venue is improper, may sua sponte transfer the case to a district where venue is proper, pursuant to 28 U.S.C. § 1406(a). Starr Indemnity & Liability Co. v. Luckey Logistics, Inc., 2017 WL 2466505, at *7 n.6 (C.D. Ill. June 7, 2017). The court does so here. Because the Northern District is the situs of events described in the Complaint, venue is proper in that district. 28 U.S.C. § 1391(b)(2). The court hereby directs the clerk to transfer this matter to the Northern District of Illinois. This case is terminated in the Central District of Illinois.(AEJ)
