TEXT ORDER entered by Chief Judge Sara Darrow on March 5, 2025. When opening this case, Attorney Rothman incorrectly classified it as seeking to bar or mandate statewide or nationwide enforcement of a state or federal law and, accordingly, it was put into a district-wide assignment pool per Civil Local Rule 40.1(E)(4)(b). This case does not seek such relief and thus is not subject to district wide assignment. Accordingly, the case must be randomly assigned to a judge in the appropriate division. See id. at 40.1(E)(4)(a). Plaintiff filed this case in the Urbana division, but he did not state his basis for doing so as required by Civil Local Rule 40.1(E)(2). The complaint contains no allegations indicating that this case arises out of a county in the Urbana division, so it was not properly filed in the Urbana division. See Civil LR 40.1(D). Plaintiff alleges that Defendant's principal place of business is in Clinton, Illinois, which is in DeWitt County.1 Compl. para. 2. DeWitt County is in the Springfield division. Civil LR 40.1(B). Accordingly, the Court finds that this case arises out of the Springfield division. The Clerk is DIRECTED to transfer the case to the Springfield division and assign a judge pursuant to standard procedures. (LN) |
