![]() ORDER granting 2 Motion for Leave to Proceed in forma pauperis. Under 28 U.S.C. § 1915 and DUCivR 3-2(b), the court must screen the complaint and dismiss the action or claim, in relevant part, if it is frivolous or malicious, fails to state a claim upon which relief can be granted, or seeks monetary relief against an immune defendant. The court finds Plaintiffs complaint states claims that are sufficiently cognizable to survive the courts initial screening inquiry. Under 28 U.S.C. § 1915(d) and DUCivR 7-4, the Clerks Office is directed to effectuate service consistent with Rule 3 of the Supplemental Rules for Social Security Actions under 42 U.S.C. § 405(g). The clerk is ordered to file the complaint and to notify the Commissioner of the commencement of the action by transmitting a Notice of Electronic Filing to the appropriate office within the Social Security Administrations Office of General Counsel and to the United States Attorney for the district where the action is filed.
