![]() ORDER DISMISSING CASE AND ASSESSING SANCTIONS. Plaintiff Louis Gonzales, a self-represented prisoner in the Texas Department of Criminal Justice, filed a handwritten letter that the Court interpreted as a civil-rights complaint under 42 U.S.C. § 1983. See Dkt. No.1 . For the reasons discussed herein, this action is dismissed with prejudice as barred by the three-strikes provision of 28 U.S.C.§ 1915(g). Alternatively, Plaintiff's complaint is dismissed with prejudice as frivolous and malicious under 28 U.S.C. § 1915(e)(2)(B) and 1915A(b). Plaintiff is barred from proceeding with any future civil-rights complaints-in this Court or any court removable or transferrable to this Court-unless he first: (1) pays the applicable filing fee in full, and (2) obtains leave to file it from a judge of the United States Court of Appeals for the Fifth Circuit, a United States District Judge, or a United States Magistrate Judge through a proper motion for leave to file the action. Any pending motions are denied. The Court warns Plaintiff that further flings of frivolous or malicious complaints will result in the imposition of additional, increasingly more severe sanctions, including but not limited to, monetary sanctions. (Ordered by Judge James Wesley Hendrix on 3/27/2025) (grl) |
