** TEXT ONLY ORDER ** Defendants have filed a motion to stay discovery pending resolution of their motion to dismiss. Dkt.6 . Plaintiffs, in turn, have filed a motion to suspend all deadlines in the case pending resolution of their forthcoming motion for remand, which they intend to file by April 21. Dkt.9 . Plaintiffs do not oppose staying discovery, id. at 2, and defendants do not oppose staying the case deadlines, dkt.11 , except they want plaintiffs to answer their counterclaim to ensure the initial pleadings are complete. The court typically does not stay discovery pending motions to dismiss, and normally would set a case schedule even with a motion to remand pending, since discovery taken now for this federal proceeding would likely still be used in any remanded proceeding. But there appears to be enough issues in flux in this case that holding off on discovery and additional briefing would promote efficiency. Accordingly, the court GRANTS the motion to stay discovery, Dkt.6 , and the motion to suspend the deadlines, Dkt.9 , with the exception that the parties must complete the briefing on the forthcoming motion for remand and plaintiffs must still answer the counterclaim. This will allow the court to assess all claims and defenses when considering the motion for remand. But the court will RESET plaintiffs' deadline to answer the counterclaim to April 28, 2025, to allow plaintiff to first focus on filing the motion for remand.
