TEXT ORDER: Petitioner has filed a habeas petition under 28 U.S.C. § 2254 challenging his state conviction in the Circuit Court of Cook County, Illinois, Case No. 16-CR-4617-01. Cook County is situated in the federal judicial district for the Northern District of Illinois. 28 U.S.C. § 93(a)(2). Petitioner is confined within this District at Illinois River Correctional Center in Canton, Illinois. Under 28 U.S.C. § 2241(d), a state prisoner may file a petition for a writ of habeas corpus in either the federal judicial district of his confinement or the federal judicial district of his conviction. Generally, a habeas corpus petition is most desirable in the district where the material events took place and where the records and witnesses are likely found. Braden v. 30th Judicial Circuit Court of Kentucky, 410 U.S. 484, 493-94 (1973). In its discretion, the Court finds that the Northern District of Illinois is a more convenient forum for this action, as all records and potential witnesses are in that District. Nothing within the Petition indicates that the Central District of Illinois is a better forum than the Northern District of Illinois. Section 1404(a) authorizes the Court to transfer this action to any other district where it might have been brought, based on the convenience of parties and witnesses and in the interest of justice. 28 U.S.C. § 1404(a). Therefore, pursuant to 28 U.S.C. §§ 2241(d) and 1404(a), IT IS ORDERED that this action be transferred to the Northern District of Illinois for preliminary consideration under Rule 4 of the Rules Governing Section 2254 Cases.
