IT IS FURTHER ORDERED this action is DISMISSED without prejudice for failure to state a claim upon which relief may be granted. See 28 U.S.C. § 1915(e)(2)(B). IT IS FURTHER ORDERED that to the extent plaintiff is pursuing state law claims, the Court declines to exercise jurisdiction over such claims. See 28 U.S.C. § 1367(c). IT IS FURTHER ORDERED that plaintiff's motion to appoint counsel [ECF No. 3] is DENIED as moot. A separate Order of Dismissal shall accompany this Opinion, Memorandum and Order.
