ORDER: Wiley's3 MOTION for Leave to Proceed in forma pauperis is Granted. pla to pay $350 filing fee: (a) Wiley lacks sufficient income to pay the initial partial filing fee and that payment is DEFERRED; (b) the clerk shall serv a copy of this Order and Notice of Payment upon the Jailer/Warden; (c) Each month the custodian shall send the clerk payment equal to 20% of the preceeding month's income, if that amount exceeds $10; 2) Wiley's claims against Defts Shawn McKenzie, David Vance, Ricky Dawson and Shane Hatfield are DISMISSED and those defts are TERMINATED: 3) Wiley may proceed against Mullins, Darby, Francis, Elam, Felton and Henderson; 4) a clerk shall prepare 6 service packets including: (a) completed summons; (b) a copy of the Complaint, (c) this Order and (d) an USM Form 285; 5) the clerk shall send the packets to the USMS in Lexington and note the date delivered; 6) the USMS shall personally serve defts at EKCC through arrangements with the institution; 7) w/i 21 days the defts must respond to the Complaint; 8) Wiley must immediately advise the clerk of any change in address.
