Text Order TAKING UNDER ADVISEMENT1 Petition for Disinterment entered by Judge Xavier Rodriguez. Petitioners, the parents of the deceased, have provided their signed and notarized Disinterment Affidavits, VA Form 40-4970 signifying their wish that their son, Jason Andre Sedita, be disinterred from Ft. Sam Houston National Cemetery so that he may be buried in the Sedita family plot at Oakwood Cemetery in Penfield, New York. Under 38 U.S.C. § 38.621(b)(1)(ii), disinterment requests must include notarized statements of consent by all living immediate family members of the decedent. Immediate family members are defined to include, inter alia, the appointed guardian(s) of minor children of the decedent. See 38 C.F.R. § 38.621(a)(2)(ii). Petitioners' supporting documentation does not appear to include a notarized Disinterment Affidavit signed by the appointed guardian(s) of the decedent's minor son, G.F.
