NOTICE OF INSUFFICIENCY. The plaintiff has filed a motion for leave to proceed in forma pauperis ; in other words, he seeks to commence a federal lawsuit without pre-paying the $405 filing fee. A federal law, 28 U.S.C. § 1915, permits him to do so if, among other things, he submits a financial affidavit showing that he is unable to pay, accompanied by a certified copy of his inmate trust account statement for the six-month period preceding his complaint. To assist inmates in demonstrating inability to pay, the District of Connecticut has prepared a standard-form in forma pauperis application.
In this case, Mr. Asiam submitted the correct form, but it leaves the Court with questions about his expenses. Expenses are important to the analysis of whether an in forma pauperis applicant is "unable to pay." See Rosa v. Doe , 86 F.4th 1001 (2d Cir. 2023). The Court has a commissary price list and knows what things cost in prison, and Mr. Asiam will need to provide additional detail about his claim to spend nearly $300 per month on necessities of life that are not provided for him by the DOC. Additionally, the trust account statement that Mr. Asiam submitted does not cover the six-month period preceding his complaint. His application is therefore insufficient
The Clerk of the Court is respectfully directed to send the plaintiff a blank copy of the application form at his address of record. Mr. Asiam is directed to fill it out completely and truthfully. In particular, he is directed to accurately state and explain in detail all of his expenses under penalty of perjury, including but not limited to medical debts, court fines, student loans, support orders, and any necessities of life that are not provided for him by his correctional facility. Vague descriptions of general categories of expenses - for example, "commissary" - will not suffice. If the form does not provide enough room for him to provide full detail, he may attach additional pages. He is further directed to file the application form with the Clerk of the Court along with a certified copy of his inmate trust account statement covering at least the period from September 25, 2024 , to March 25, 2025 . If he does not do so by April 18, 2025, his case may be dismissed.
