ORDER terminating237 Letter Motion for Leave to File Document. Accordingly, the Rella Declaration will remain public only in its currently redacted form. With regard to the currently-public version of the Withdrawal Declaration, the redactions shield from disclosure a dispute over invoices for attorneys' fees between Hornbeam and its former counsel. These communications are not within the scope of the attorney-client privilege, because they were not made "for the purpose of providing or obtaining legal advice." Swerdlow, 259 F.R.D. at 70. Indeed, "statements pertain[ing] to [a] fee dispute" are generally "outside the attorney-client privilege." See Diamond "D" Const. Corp. v. N.Y.S. Dep't of Lab., No. 00-CV-335C(F), 2004 WL 1663992, at *2 (W.D.N.Y. July 23, 2004) (citing Vingelli v. United States, 992 F.2d 449, 453 (2d Cir. 1993)). As such, the Withdrawal Declaration will also be publicly released in its entirety. The Clerk of Court is respectfully directed to file publicly the versions of the Declarations that I have provided.
