ORDER: On January 15, 2016, Magistrate Judge Gabriel W. Gorenstein issued an order directing Plaintiff to explain in writing, by February 5, 2016, why this case should not be dismissed for the reasons stated in the Suggestion of Immunity filed by the United States of America on October 6, 2015. See ECF Nos. 4, 5. The order explained that if Plaintiff failed to do so, this action may be dismissed pursuant to Rule 41(b) of the Federal Rules of Civil Procedure. To date, Plaintiff has not responded to Judge Gorenstein's order. In light of the Second Circuit's decision in Baptiste v. Sommers, 768 F.3d 212 (2d Cir. 2014), the Court affords Plaintiff an additional 30 days to provide her written explanation. Accordingly, it is ORDERED that Plaintiff shall file her explanation by May 9, 2016. Failure to comply with this order shall result in dismissal of the action pursuant to Rule 41(b) of the Federal Rules of Civil Procedure.
