ORDER: Defendant's Motion to Dismiss (Doc. No.102 ) is granted absent objection. Mr. Howell is the sole remaining plaintiff in this case. This Motion to Dismiss sought to dismiss Counts One, Two, and Three, which relate to a snow removal contract to which Mr. Howell was not a party. Mr. Howell has filed no opposition to the Motion to Dismiss and conceded in his Memorandum in Opposition to the defendant's Motion for Summary Judgement (Doc. No.117 ), that the only claim remaining in this case is one for intentional infliction of emotional distress. See Memorandum in Opposition (Doc. No.117 ) at 3. As such, the defendant's Motion to Dismiss (Doc. No.102 ) is granted. SO ORDERED by Judge Janet C. Hall on 2/11/2025. (DeRubeis, B.)
